This website is operated by Yoga with Melissa (Melissa  Schuler). Throughout the site, the terms “we”, “us” and “our” refer to Yoga with Melissa (Melissa Schuler). Yoga with Melissa (Melissa Schuler) offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted by Wix Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Refund Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Yoga with Melissa (Melissa Schuler) and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

With the purchase of a product or service you are accepting this agreement voluntarily and recognize that your purchase serves as complete and unconditional release of all liability to the greatest extent allowed by law in Germany.

Disclaimer regarding the practice of yoga

​

With the purchase of a product or service you accept and understand that yoga includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If you experience any pain or discomfort, you will listen to your body, discontinue the activity, and ask for support from the instructor. You assume full responsibility for any and all damages, which may incur through your participation.

 

Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By purchasing a ticket to a yoga class, yoga course, yoga workshop, yoga retreat or yoga program with Yoga with Melissa (Melissa Schuler), you affirm that a licensed physician has verified your good health and physical condition to participate in such a fitness program. In addition, you will make the instructor aware of any medical conditions or physical limitations before class. If you are pregnant, become pregnant or are post-natal or post-surgical, you will not attend the class, unless the class is specially designed for pre-natal or post-natal stages. You also affirm that you alone are responsible to decide whether to practice yoga and participation is at your own risk. You hereby agree to irrevocably release and waive any claims that you have now or may have hereafter against Yoga with Melissa (Melissa Schuler) and it's instructors.

 

With the registration for a class, course, workshop, retreat or program you accept that you have read and fully understand and agree to the above terms of service. You are accepting this agreement voluntarily and recognize that your purchase and/or registration serves as complete and unconditional release of all liability to the greatest extent allowed by law in Germany.

Refund and Cancellation Policy

​

Cancellations later than 12 hours prior to class, workshop or event start time will not be refunded. The student can receive a credit towards a future class, event or workshop based on membership level, availability and similar cost. 

​

Purchases of online products cannot be refunded.

​

Cancellation Windows

Weekly Online Classes (Class Pass or Drop in) and Workshops or similar events
12 hours before event starts.

All Class Passes are non-refundable, non-transferable and have strict expiration dates in exchange for great discounts. If cancelling a class within the cancellation window, the unused class credit will be moved to your account and expire within the plan's set expiration date. No refunds will be provided for unused sessions.

Memberships on AutoRenew (after min term)
7 days before next monthly payment.

Private 1:1 Sessions
3 days before start date at no extra fee for refund
or 

12 hours before start date, full refund minus 10% admin fee.

Retreats and Workshops

24 hours before starts date, full refund minus 10% admin fee. 

No-shows will not be refunded.

In the event of Yoga with Melissa (Melissa Schuler) cancelling an event or class

You will receive a full refund for the price of your booking only, or the option of being transferred to another workshop or a credit to your account. In the event a teacher is taken ill, every attempt will be made to find a replacement teacher.

We regret no refund or transfer can be given outside of these terms, including if you are unable to attend due to illness, injury, work/family changes, pregnancy or other reasons. Before committing to a course or event, please ensure you can attend the scheduled number of sessions to get the most out of the program. This cancellation policy is firm. If you are concerned about the possibility of needing to cancel your event, we highly recommend taking out cancellation insurance.

Waiting Lists

When a space becomes available prior to the class start time, the first person on the waiting list will be added to the class and the booking system will email the person a notification. If a confirmation is not received prior to the start of class we cannot guarantee the availability of the space. Once the space has been confirmed, our booking terms apply.

Class Pass Expiration

​

Class Passes cannot be extended beyond their expiration date unless Yoga with Melissa chooses to do so. If there is credit remaining on a class pass and it expires, the credit will no longer be valid.

Class Changes, Substitutions & Change of Teacher

​

Classes may be cancelled, teachers may be substituted or removed. No refunds are given because of timetable changes.
